TERMS AND CONDITIONS FOR EMPLOYEE USE OF MAGNUS MARINE'S PCM QC APP

This application is intended strictly for the use of Magnus Marine employees only; third parties are strictly forbidden. By signing up and using the PCM QC App ("Application"), you, as an employee ("you" or "Employee"), agree to be bound by these terms and conditions ("Terms") set forth by Magnus Marine ("Company" or "we"). If you do not agree to these Terms, you must not access or use the Application.

Access and Use of the Application

1. The Company grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Application for the sole purpose of performing your job duties.
2. You shall not use the Application for any personal, commercial, or unauthorized purposes.
3. You are responsible for maintaining the confidentiality of your login credentials and shall not share them with any third parties. You are responsible for all activities that occur under your account.

User Conduct

1. You agree to use the Application in compliance with all applicable laws, regulations, and company policies.
2. You shall not engage in any conduct that may harm the Application, its content, or any third-party systems, including, but not limited to:
   • Unauthorized access or use of the Application or any part thereof;
   • Introducing viruses, malware, or other malicious code;
   • Using the Application to transmit, distribute, or store any material that is unlawful, offensive, or infringes upon the rights of others;
   • Engaging in any activity that disrupts, interferes with, or adversely affects the normal functioning of the Application.

Intellectual Property

1. All intellectual property rights in the Application, including but not limited to its design, content, software, and any other materials, are owned by the Company or its licensors. You shall not copy, reproduce, modify, distribute, or create derivative works from the Application without the Company's prior written consent.

Data Privacy

1. The Company is committed to protecting your personal data. Any personal data provided by you or collected during your use of the Application will be processed in accordance with the Company's Privacy Policy. By using the Application, you consent to such processing and warrant that all data provided by you is accurate.

Termination

1. The Company reserves the right to suspend or terminate your access to the Application at any time, with or without notice, for any reason, including, but not limited to, breach of these Terms.

Limitation of Liability

1. The Application is provided "as is," and the Company makes no warranties, express or implied, regarding its quality, accuracy, or suitability for any purpose. To the fullest extent permitted by law, the Company shall not be liable for any damages, including, but not limited to, data, or business interruption, arising out of or in connection with your use of the Application.

Changes to These Terms

1. The Company reserves the right to amend these Terms at any time, and any changes will be effective immediately upon posting. Your continued use of the Application constitutes acceptance of the amended Terms.
